1. Definitions

"KolabX," "we," "us," or "our": Refers to KolabX Entertainment Private Limited.
"Platform": The KolabX website, mobile application, and all associated services.
"User," "you," or "your": Any individual or entity accessing or using the platform.
"User Content": Any content (text, images, videos, etc.) that a user uploads or shares on the platform.

4. Account Registration and Responsibilities

Account Creation: To access certain features of KolabX, you must create an account by providing accurate and complete information, including a valid email address.
Account Security: You are responsible for safeguarding your account details and ensuring the security of your password. Notify KolabX immediately if you suspect any unauthorized access to your account.
Account Sharing: You agree not to share your account or allow others to access it using your credentials.

5. Subscription and Fees

5.1. Refunds & Cancellations

At KolabX, we strive to ensure customer satisfaction. If you are not satisfied with your subscription or collaboration services, you may request a refund within 7 days of purchase.

Refund Processing: Once a refund request is approved, the amount will be credited back to your original payment method within 5-7 working days. Please note that refunds are only applicable for unused subscription services. Once collaborations are initiated or profiles have been activated, refunds may not be processed.

Subscription Plans: KolabX offers several subscription options:

Promotional Offer: Subscriptions are free for the first year as a special offer. After the promotional period, users will be billed according to their chosen subscription plan (monthly, annually, or lifetime).
Payment Terms: By subscribing, you agree to pay all applicable charges after the promotional period unless you cancel before the renewal date. Payments are non-refundable unless stated otherwise.
Renewal and Cancellation: Users are responsible for managing their subscription renewals and cancellations. Instructions for managing subscriptions are available under "User Settings.

6. User Conduct

Users agree to use KolabX in compliance with all applicable laws and these Terms of Service. The following conduct is prohibited:

Harassment or Threatening Behaviour: Do not harass, defame, or threaten others.
Impersonation or Misrepresentation: Do not impersonate anyone or misrepresent your affiliation.
Intellectual Property Infringement: Do not upload or distribute content that infringes on intellectual property or privacy rights.
Illegal or Fraudulent Activities: Do not engage in illegal, deceptive, or harmful activities.
Spam and Unsolicited Messages: Avoid sending spam, advertisements, or promotions without consent.

7. Content Ownership and Licensing

User Content: You retain ownership of any content you upload or post on the platform. By submitting User Content, you grant KolabX a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content as needed to operate the services.
KolabX Content: All content, materials, and design elements provided by KolabX, including software, visuals, and trademarks, are owned by KolabX or its licensors. You may not copy, modify, or distribute KolabX content without prior permission.

8. Collaboration and Communication

Facilitation of Collaboration: KolabX enables users to communicate and collaborate on projects. However, users are solely responsible for managing their collaborations, including communication and expectations.
Disclaimer: KolabX does not guarantee the success or quality of any collaboration. Users must independently handle any disputes or issues that arise.

9. Data Privacy and Security

Data Handling Practices: Collection, use, and protection of your personal data are governed by our Privacy Policy, which explains how your data is managed, including for payments, collaboration activities, and account deletion.
User Rights: You may have rights to access, correct, or delete your personal data, depending on your location. More details are available in the Privacy Policy.
Compliance with Applicable Laws: KolabX complies with relevant data protection laws (e.g., GDPR, CCPA). Refer to the Privacy Policy for your rights and how to exercise them.

10. Termination of Service

KolabX's Right to Terminate: We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service.
User-Initiated Termination: You may close your account at any time by following the account deletion process in "User Settings." Data retention practices following account closure are outlined in the Privacy Policy

11. Limitation of Liability

KolabX is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the platform, including:

Disputes Between Users: Any conflicts or disagreements between users.
Data or Content Loss: Loss of data, content, or access to services.
Unauthorized Access: Any breaches in account security.

12. Indemnification

You agree to indemnify KolabX, its affiliates, and agents from any claims, liabilities, damages, or expenses arising from your use of the platform or violation of these Terms of Service.

Dispute Resolution: Any disputes will be resolved through arbitration in Mumbai, India, following the Indian Arbitration and Conciliation Act, 1996.

Account Deletion: KolabX provides in-app account deletion functionality as required by app stores. Users can delete their accounts through the "User Settings" section.
Subscription Management: Users can manage subscriptions via the app or the respective app store. Payment terms and refund policies are subject to app store requirements.
