1. Definitions

“Platform” refers to the KolabX website, mobile application, and associated services.
“User” refers to anyone who accesses or uses the platform, including registered members.
“Content” refers to all materials, including text, images, videos, and other content that users submit, post, or otherwise share on KolabX.
“Subscription” refers to paid membership options for additional services on the platform.

2. Account Registration and Responsibilities

2.1. Eligibility
To register for an account and use KolabX, you must be at least 18 years old or meet the minimum legal age required in your jurisdiction. By registering, you confirm that the information you provide is accurate, complete, and up-to-date.

2.2. Account Security
You are responsible for maintaining the confidentiality of your account credentials (username and password) and for any activity that occurs under your account. KolabX cannot and will not be liable for any loss or damage arising from your failure to protect your credentials. Notify us immediately if you suspect unauthorised access to your account.

2.3. Account Termination
We may suspend or terminate a user's account for violations of these Terms or misuse of the platform. In cases of serious violations, such as posting sensitive content, we will block the account immediately while investigating. If the violation is confirmed, the account may be permanently suspended.

2.4. Account Deletion
KolabX provides in-app account deletion functionality, allowing users to delete their accounts directly through the app's "User Settings" page. Once you delete your account, all associated data will be permanently removed, except where retention is required by law or for legitimate business purposes.

3. User Conduct

3.1. Acceptable Use
By using KolabX, you agree not to:

Use the platform for any unlawful purpose or in violation of any local, state, national, or international laws.
Post content that is defamatory, obscene, abusive, or infringes on the intellectual property rights of others.
Attempt to gain unauthorised access to the platform’s systems, data, or other users' accounts.
Use the platform to harass, stalk, or threaten other users.
Introduce viruses, malware, or any other harmful code to disrupt the platform’s functionality.

3.2. User Responsibility
You are solely responsible for all content you submit, post, or share on the platform. By submitting content, you represent that you have the necessary rights to do so, and that your content does not infringe upon the rights of others. KolabX reserves the right to remove content or accounts that violate these Terms.

4. Subscription and Payment Terms

4.1. Subscription Plans
KolabX offers two subscription models:

General Subscription: Allows users to showcase their profiles on the platform.
Collaboration Fee: Users pay ₹100 per collaboration to activate the chat feature and engage in project discussions.

4.2. Payment Processing
All payments are processed securely through third-party payment processors. By subscribing, you authorise KolabX or our third-party payment processor to charge your chosen payment method for the applicable fees.

4.3. Refunds & Cancellations

At KolabX, we strive to ensure customer satisfaction. If you are not satisfied with your subscription or collaboration services, you may request a refund within 7 days of purchase.

Refund Processing: Once a refund request is approved, the amount will be credited back to your original payment method within 5-7 working days. Please note that refunds are only applicable for unused subscription services. Once collaborations are initiated or profiles have been activated, refunds may not be processed.

Subscription and collaboration fees are non-refundable unless required by law.
If a payment transaction issue arises (e.g., incorrect charge, duplicate payment), KolabX will refund the amount within 3 working days after receiving the user's request.
Users are responsible for managing their subscriptions and canceling them if they no longer wish to use the service. KolabX is not liable for unintended charges due to failure to cancel subscriptions in a timely manner.

4.4. Subscription Management
Users can manage their subscriptions through the App Store if purchased via Apple, or through the KolabX app for other payment methods. Instructions for canceling subscriptions are provided in the "User Settings" page of the app.

4.5. Failed Payments
If a payment cannot be processed due to insufficient funds, expired payment methods, or other reasons, access to premium features may be restricted until the payment is successfully completed.

5. Intellectual Property

5.1. User-Generated Content
By posting content on KolabX, users grant KolabX a non-exclusive, royalty-free, worldwide license to use the content for marketing purposes related to the platform. KolabX does not claim ownership over user-generated content. Users are responsible for ensuring that the content they post does not infringe on any third-party intellectual property rights.

5.2. Copyright Infringement
If you believe any content on the platform infringes your intellectual property rights, please contact support@kolabx.com. We will take appropriate action, including the removal of infringing content, if necessary.

6. Data Privacy and Security

6.1. Data Collection
KolabX collects personal data as described in our Privacy Policy. By using the platform, you agree to the collection, use, and storage of your information in accordance with that policy.

6.2. User Rights (GDPR/CCPA)
Depending on your location, you may have certain rights concerning your personal data:

Access: Request a copy of the data we hold about you.
Correction: Request correction of inaccurate data.
Deletion: Request deletion of your personal data.
Opt-Out: Unsubscribe from marketing communications.

6.3. Data Security
We take reasonable precautions to protect your data from unauthorized access, disclosure, or alteration. However, no online service can guarantee absolute security.

KolabX uses cookies and similar tracking technologies to enhance the user experience and analyze app performance. For details, please review our Cookie Policy. You can manage cookie preferences in your browser settings.

7. Limitation of Liability

KolabX provides the platform "as is" and "as available." To the fullest extent permitted by law, KolabX will not be liable for any direct, indirect, incidental, or consequential damages arising from your use of or inability to use the platform.

8. Indemnification

You agree to indemnify and hold harmless KolabX, its affiliates, and agents from any claims, liabilities, damages, or expenses arising from your violation of these Terms.

9. Modifications to the Terms

KolabX may update these Terms at any time. Changes will be notified via email or the app. Continued use of the platform indicates acceptance of the revised Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Mumbai, India.

11. Severability

If any provision of these Terms is found unlawful or unenforceable, that provision will be removed, while the remaining provisions will remain in effect.

12. Electronic Communications

By using the platform, you consent to receive electronic communications from KolabX.

13. Accessibility of the Terms and Privacy Policy

The Terms and Conditions, along with the Privacy Policy, are easily accessible within the app under the "User Settings" page.
